Noncitizens And Criminal Offenses
On July 21, 2014, California Governor Jerry Brown signed into law a measure (SB 1310) aimed at reducing deportations of noncitizens who are legal residents convicted of misdemeanors. This measure effectively reduced the maximum legal sentence in California for such offenses from 365 days (one year) to 364 days. Under federal immigration law, a felony is a crime punishable by 365 days or more and can result in a noncitizen legal resident being deported. Many of these crimes are property offenses and not violence related. As a result of the conflict between state and federal sentencing laws prior to SB 1310, legal residents could be torn from their families for committing relatively minor crimes.
The new law that takes effect Jan. 1, 2015, will protect thousands of legal residents who might otherwise face deportation proceedings. California continues to advance state legislation to ensure aspiring citizens are integrated into the community.
