Eligibility For Asylum

The United States offers asylum to those who are seeking protection because they have suffered or are in fear they will suffer persecution in their home country because of their race, religion, political affiliations, nationality or membership in a particular social group. If you are a foreign national in fear of persecution for any of these reasons were you to return to your home country, the United States recognizes that remaining here may be the only option to keep you and your family from violence and possibly death. Spouses and children under the age of 21 may also be included in an asylum request.

Applying for asylum in the United States is a complicated process. The petition must be filed in a timely manner (within one year of arriving to the United States) under U.S. immigration law. And you must be able to prove to any asylum officer that you would face persecution were you to return to your home country. If your petition is granted, you will be allowed to remain in the United States without fear of being sent back to your home country.
